As a dedicated Realtor, I had an enriching experience with repeat clients looking to expand their investment portfolio. They already had long-term rentals and a short-term rental property, but this time they wanted something different, a property that could double as a short-term rental and an event center perfect for gatherings.


Challenge #1: Restrictions and Property Issues Were Not Disclosed


My clients found a property they liked, but the first challenge began when we discovered restrictions that weren't initially disclosed. This was a major hurdle, as my clients had specific plans for the property that the hidden restrictions could affect.


Solution: Skilled Negotiation and Contract Objections


Anticipating potential issues, we included safeguard clauses in our contract. This paid off when we encountered the undisclosed restrictions because were were able to lean on our contractual safeguards to buy ourselves time to strategize. Our solution involved demonstrating that these restrictions had been historically unenforced, thereby mitigating their impact. This resolved the immediate issue but also fortified our position for any future challenges related to these restrictions.


Challenge #2: Title Issues


The transaction was further complicated when we discovered that part of the property marketed for sale wasn't legally theirs.


Solution: Tracking it back


Working with the title company, we traced back and completed the necessary transactions to rightfully transfer the property.


Challenge #3: The Survey


The last major hurdle was the survey because it showed multiple encroachments and that their property was in use by a different party.


Solution: A Plan of Correction


Working with the title company and owner of the property unknowingly encroaching, we were able to identify how to correct the encroachment and to get all parties to agree to a solution.

Each obstacle in this transaction was significant enough to derail the deal, but thanks to our diligence and expertise, we overcame them.
